PASSENGER PERSONAL ACCIDENT INSURANCE POLICY|

HOW YOUR INSURANCE OPERATES
Your Passenger Personal Accident Policy is a contract between us, MSIG Insurance (Malaysia) Bhd and you, the holder of the Certificate on behalf of each Insured Person named herein. 

In consideration of you paying to us the required Premium, we shall be responsible in the manner and to the extent described in the Policy and in the Schedule of Benefits, in respect of events occurring within the Territorial Limits during the Period of Insurance for which you pay and we accept the required Premium.

DEFINITION OF WORDS
1.

Insured Person/You/Your
means each person named in the Certificate of Insurance.

2.

We/Our/Us/The Company/MSIG
means MSIG Insurance (Malaysia) Sdn Bhd.

3.

Adult
means an Insured Person aged between 18 to 80 years at the commencement of any Journey.

4.

Child
means an Insured Person aged above 30 days and below 18 years at the commencement of any Journey.

5.

Period of Insurance
means the duration of the Journey as shown in the certificate.

6.

Journey
means any trip that commences from the time you board the carrier at embarkation point until you alights from the carrier at the disembarkation point as specified in the Electronic Slip.

7.

One Way Cover
means a journey that commences when you board the carrier at embarkation point until your  scheduled time of arrival at your final destination. Cover will terminate upon disembarkation as specified in the Electronic Slip at your final destination or expiry of period of insurance whichever is the earlier.

8.

Two Way Cover
means a journey that commences when you board the carrier at embarkation point until your scheduled time of arrival at your final destination, and the return journey from your final destination to your original embarkation point in your home territory.  In both events, cover will terminate upon disembarkation point as specified in the Electronic Slip or expiry of period of insurance whichever is the earlier.

9.

Accident
means any sudden or unexpected and violent event on the part of the insured person, resulting directly and independently from the action of an external cause, other than any intentionally self-inflicted injury.

10.

Injury
means death and/or bodily injury suffered caused solely by an accident while riding, boarding or alighting the carrier and not by sickness, disease or gradual physical or mental wear and tear occurring during the period of insurance.

11.

Medical Practitioner/Physician
means a properly qualified medical practitioner licensed by the competent Medical Authorities of the country in which treatment is provided and who is rendering such treatment is practising within the scope of his or her licensing and training.

12.

Carrier(s)
means the entity that transports you and your luggage in the course of the journey by land which operates under a licence for the transportation of passengers.

13.

Territorial Limits
Malaysia, Singapore & Thailand.

SECTION I – PERSONAL ACCIDENT
For each insured person, subject to the terms and conditions of the Policy and also to our satisfaction, we shall pay up for bodily injury sustained by you and caused entirely by violent, accidental, external and visible means occurring during the journey and within the period of insurance and which independently and solely results in the benefits shown below.

Benefit 1 Death
Benefit 2
Total and permanent loss of sight in one or both eyes or total loss by physical severance or total and permanent loss of use of one or both limbs.
Benefit 3

Permanent and total disablement from engaging in employment or occupations of any and every kind.

For each insured person we will not pay or be liable for:
(a) more than one of the above Benefits  resulting from the same injury.
(b) injuries arising from manual work in connection with any trade, employment and
     profession.

SECTION II - MEDICAL BENEFITS
In any claim arising from your death, bodily injury or illness during the journey, our reimbursement to insured person, if any, shall be pursuant to the terms and conditions of the Policy and the amount and manner of reimbursement shall be as follows:-

We will reimburse up to the maximum limit as per Schedule of Benefits such fees or charges or expenses as stipulated in the Policy (if any) and/or as may be determined by us for:
(a) medical, surgical, hospital, nursing home or nursing services.
(b) Emergency dental treatment for the alleviation of sudden pain or treatment for
     damage to sound and natural teeth provided such damage is caused solely by
     injury.

Our reimbursement shall not cover the following fees or charges or expenses:
(a) fees or charges for repairs to or for the provision of dentures or artificial teeth.
(b) any dental work involving the use of precious metals.
(c) Dental treatment / repairs where the cause is due to normal wear and tear or
     normal maintenance of dental health.
(d) any charges for traditional treatment.
(e) ophthalmological care, eye glasses, contact lenses and hearing aids or
     prescriptions for the same.
(f) fees or charges or expenses for your burial or cremation.
(g) fees or charges or expenses for your conveyance of your body to your country of
     residence.
(h) Fees or charges or expenses arising from manual work in connection with any
     trade, employment and profession.

SECTION III - LUGGAGE / BAGGAGE
In any claim for theft or loss of your personal luggage during your journey, our reimbursement, if any, shall be only up to the maximum amount of RM500 for each passenger subject to terms and conditions and less deduction of any wear, tear or depreciation or any compensation paid either by the carrier or others.  The luggage must be owned by you and in your possession and/or accompany you and include suitcase, trunks and the like exclude golf set.

The luggage/baggage must be tagged with the Platinum Star tag and kept/store in the lower coach compartment of the Carrier during the journey.

Our reimbursement shall not cover the following:-
(1) Hand-carried luggage
(2) Luggage without the Platinum Star tag
(3) Luggage not kept at the coach lower compartment
(4) Golf-sets, note-books, lap-tops, portable computer equipment, musical
     instruments, fragile articles, cell phones, antique, equipment for recording of
     sound and/or pictures and its accessories.
(5) Platinum Star will not be responsible for any loss during the inspection of the
     custom.

GENERAL CONDITIONS
Any claim pursuant to the Policy and/or the terms and conditions herein shall be subject to the following:-

1) You have observed the following:
 

a) Taking reasonable and proper care to safeguard against accident, injury, loss
    or damage,
b) Reporting in writing to us within 7 days from the accident, the full details of
    any accident, which may result in a claim under the Policy.
c) Producing the Certificates of Insurance and/or Ticket Butt before a claim is
    admitted
d) To lodge a police report and to report to the carriers within 24 hours of the
    occurrence incident of any loss or theft. In either case, a written report must
    be obtained from the Police or carriers and forwarded to us.
e) Having sought medical advice on the advisability of taking the journey when
    you received medical treatment as a hospital in-patient during the 6 months
    preceding the journey booking.
f) Not travelling contrary to medical advice or specifically to obtain medical
    treatment.
g) Suffering from any previously diagnosed anxiety state
h) Not to make any alterations and/or additions to the printed terms and
    conditions of the Policy save and except with our express written consent and
    any alterations and/or additions to the Policy shall be initialled at our office by
    an authorized employee of our company.

2) You have acknowledged and recognised our rights as follows to:

 

a) We shall not be responsible and paying for any claim, which is in any way
    fraudulent.
b) We shall only reimburse a claim once under the Policy and we shall not be
    liable or entertain any further claim under other and/or different insurance
    policy.
c) we shall only pay a proportion of a claim where there is other insurance in
    force covering the same risk and details of such other insurance shall be
    provided to us.
d) We shall not refund the premium which has been paid for.
e) We reserve the right to cancel all coverage under the Policy immediately
    without notice to you if we are satisfied and convinced that the claim is
    fraudulent, dishonest or exaggerated in any way and we reserved the right to
    notify the police of any such claim.

GENERAL EXCEPTIONS
1) We will not pay nor be liable for any deterioration of, or loss of or damage to property, or any legal liability, injury, illness, death or expense caused by or contributed to, or arising from:

 
a) war, invasion, act of foreign enemy, hostilities (whether war be declared or
    not), civil war, rebellion, revolution, terrorism, insurrection or military or
    usurped power, martial law or state siege or any of the events or causes which
    determine the proclamation or maintenance of martial law or state of siege.
    Acts of terrorism means an act including but not limited to the use of force or
    violence and/or the threat thereof, of any person or group(s) of persons,
    whether acting alone or on behalf of or in connection with an organisation(s)
    or government(s), committed for political, religious, ideological, or similar
    purposes including the intention to influence a government and/or to put the
    public or any section of the public, in fear.
b) riot or civil commotion, lockout or threat of such event.
c) HIV (Human Immunodeficiency Virus) and/or HIV-related illness including
    AIDS (Acquired Immune Deficiency Syndrome) however caused and/or any
    mutant derivatives, variations or treatment thereof however caused.
d) delay, confiscation, detention, requisition, damage, destruction, or any
    prohibitive regulations by Customs or other Government Officials or
    Authorities of any country.
e) ionising radiation or contamination by radioactivity from any nuclear waste
    from combustion of nuclear fuel.
f) the radioactive toxic explosive or other hazardous properties of any explosive
    nuclear assembly or nuclear component thereof.
g) persons below the age of 31 days or over 80 years of age at the
    commencement of the journey.
h) you travelling in a vehicle other than as a fare paying passenger in the license
    bus or schedule service which any member of the public can join at the
    recognised stop.
i) your suicide, self-injury or wilful exposure to peril (other than in an attempt to
    save a human life).
j) you being under the influence of drugs or other substance abuse (other than
    those prescribed by a registered medical practitioner but not when prescribed
    for the treatment of drug addiction).
k) Solvent abuse.
 l) you being under the influence alcohol or intoxicating liquor.
m) you participating in a hazardous adventure.
n) any costs of treatment in respect of pregnancy, childbirth, miscarriage,
    abortion or menopause.
o) illness or disorders of a psychological nature, nervous depressions, any
    anxiety state and/or nervous depressions, mental illness.

2) Our maximum aggregate liability in respect of all insured person travelling in any one surface transport vehicle shall not exceed the Conveyance limit of RM1,000,000 or the aggregate amount of compensation payable in respect of such insured persons, whichever is less.

DECLARATION CLAUSE
This is an open policy issued to Platinum Star Coach Sdn Bhd covering any eligible passengers travelling/using their coach/transportation during the Period of Insurance.
It is understood and agreed that Platinum shall within seven (7) days of each journey furnish to MSIG a true and accurate declaration of total number of passengers and the respective cover of Plan during the Period of Insurance.  Platinum shall pay MSIG upon demand premium calculated at the rate agreed upon within sixty (60) days from the date of each journey.
 
It is a condition of this Policy that Platinum shall keep an accurate record containing all particulars relating to this Policy and shall at all times allow MSIG to inspect such records.

WHAT TO DO OF YOU WISH TO CLAIM
If an event occurred that may give rise to a claim, you should follow the procedures set out below:-

1)  Personal Accident
     • In the event of death, we shall required a copy of the Death Certificate
     • Police Report
     • Ticket Butt/certificate of Insurance

2)  Medical Expenses
     • Obtain a medical certificate from the treating Medical Practitioner
     • Itemised Bills and receipts at all expenses incurred must be kept
     • Ticket Butt/certificate of insurance

3)  Loss of Luggage
     • Written confirmation of the loss from the scheduled carrier
     • Police report, if any
     • Ticket butt/certificate of insurance
